Shrubbery and Trees |
|
Question: What do I do when my view is impacted by shrubbery or
trees?
Answer: Read your covenants, attempt to solve the problem yourself,
send a message to MHACC as outlined above taking into consideration the following:
|
(1) Review your specific Plat for language pertaining to view rights, in most cases, the MHACC only has jurisdiction over adjoining property (any point touching your property including one diagonal where 4 corners touch). Plat 16 has language governing all properties within the Plat as approved by the residents within it.
(2) Dated photos are helpful to capture the specific issue.
(3) Views are not covered by City or other codes.
(4) The MHACC may issue a letter stating that the offending property owner is in violation of covenants but cannot initiate legal action, however, since the covenants are a legal document, when residents take legal action to protect their view, court rulings appear to have followed MHACC findings.
